eRoutes is part of Imagine Run BV. 
Therefore the terms of use of Imagine Run BV applies to the use of eRoutes.

IMAGINE RUN BV ("IMAGINE RUN" or “IMAGINE”) is the provider of eRoutes. eRoutes offers routes of the distance desired to run or walk by the user. The routes can be taken at your own pace, walking or running, anywhere in the world. eRoutes guides the user in known and unknown environments via audio (via the download gpx file) and via downloadable routes for printing. It brings the user back to the starting point with a circular route. 

These terms of use describe the conditions in which eRoutes and the Subscription may
be used.

1. Definitions
1.1. Subscription: the subscription needed for the use of eRoutes. 
1.2. eRoutes: the route planner
1.3. User: the natural person who in any given way makes use of eRoutes
1.4. Terms of use: these terms of use.

2. Applicability
2.1. These Terms of Use apply to (the use of) eRoutes and the related services provided and the subscription.
2.2. The Terms of Use also apply to all information, data, images, video- and sound fragments or all other content supplied, read or spread in any other way in need of, by means of / from / in eRoutes.
2.3. By the use of eRoutes (which also means the download and the installation thereof) the User accepts these Terms of Use.
2.4. Only these Terms of Use apply, regardless of any possible (earlier) reference of the User to his/her own or other terms of use. IMAGINE explicitly rejects any possible terms of use declared applicable by the User.
2.5. Before eRoutes can be used, the User needs to separately take note of the content of the Privacy Statement and subsequently needs to accept it.
2.6. The Privacy Statement and the Terms of Use can also be consulted, downloaded, stored and printed via or at www.imaginerun.com
2.7. Where use is made by eRoutes of the services of any third party(parties), the general conditions, the privacy- and the cookie policy of the third party(parties) involved do apply. IMAGINE is not responsible for the services, the general conditions and the privacy- and cookie policy of any third party(parties).
2.8. In case via eRoutes possibly available additional services are ordered and/or there is participation in possible (promotional) actions offered, additional terms of IMAGINE could apply. In case and as far as these additional terms are in conflict with the Terms of Use, the additional terms prevail.

3. Use
3.1. The User can use eRoutes for free at www.imaginerun.com. 
3.2. For full use of eRoutes, the User needs to register via eRoutes by making a personal account. To the processing of personal data via eRoutes the IMAGINE Privacy Policy and cookie policy applies.
3.3 The User can start with a free trial version of eRoutes which offers three free routes for an indefinite period. This only requires registration of a personal account.
3.4 After the trial version, the User can expand his account with the purchase of a single route, a monthly subscription (can be canceled monthly) or an annual subscription (can be canceled annually).
3.5. Use of the single purchase or subscription is possible immediately after payment and available worldwide.

3.6. In case the User is not yet 16 years of age, the user needs to obtain permission for the use of eRoutes from his/her parents or legal guardians. By accepting the Terms of Use, the User guarantees that he/she is 16 years of age or has permission from his/her parents or legal guardians.
3.7. In order to make use of eRoutes, the user has to take care of his/her own expense for the necessary equipment, system programs, and (Internet)connection.
3.8. The User uses eRoutes and the Services at his/her own risk. The responsibility for the sensible use of the Applies with the User. 
3.9. Further explanation about purchasing a subscription.

Payment method
To be able to pay a subscription fee, you must provide or provide information about your preferred payment method (for example, credit card, online payment service, a third party or any other payment method made available by IMAGINE RUN) (the "Payment Method"). If you provide your payment information, you authorize us and certain external service providers, payment card networks and payment processors to receive, store and encrypt your payment information. You can switch to a different payment method or update your information by visiting your account at www.eroutes.com. IMAGINE RUN will not refund any money other than set out in these terms and conditions. If your payment service provider determines that your account has been subject to fraudulent transactions as a result of using your payment method for the services, you must contact us immediately at www.eroutes.com.
 
Fees
To gain access to certain functions of the services, you may have to pay a subscription fee. Subscription fees can be paid monthly or annually. All subscription fees must be paid in advance. If members switch from a monthly to an annual subscription, the annual rate will take effect from the following billing date. If you upgrade your subscription or add new service categories to your account, these changes may lead to new billing date. You agree to pay the subscription fees and other costs that are charged in connection with your IMAGINE RUN account, whether on the basis of a single agreement or on the basis of a subscription. IMAGINE RUN reserves the right to increase the subscription fees and associated tax contributions at any time and after timely prior notice, or to set new fees.

Automatic renewal
Subscription fees are billed automatically at the start of a monthly or annual installment, as applicable. These costs are automatically renewed until your subscription has been changed or canceled. Your membership costs are the same as your initial costs unless you have been informed otherwise in advance. You can cancel your IMAGINE RUN membership at any time in the following way.

Cooling
If you live outside the United States, you may be entitled to a cooling-off period of fourteen (14) days (the "Cooling Off Period") and a full refund of the amount you paid, provided that you have not registered with the services and has not used it as an IMAGINE RUN member during the cooling-off period.

Cancellation
Cancellation of IMAGINE RUN membership.
If you have registered for IMAGINE RUN, you can cancel your subscription by going to your account page or by contacting us at www.eroutes.com. Cancellation of a subscription takes effect at the end of your current billing period. If your IMAGINE RUN membership ends, your account will continue to exist and become a free membership. You can renew your subscription at any time without opening a new account. However, it is possible that the IMAGINE RUN subscription costs have been increased in the meantime. You can delete your account at any time.

4. User rights
4.1. By using eRoutes the User obtains a non-exclusive, non-transferable, personal and revocable right for the non-commercial use of eRoutes on a smartwatch or another portable device.
4.2. IMAGINE does not offer technical assistance and can therefore not guarantee that eRoutes will function flawlessly on the device.
4.3. The User is not allowed in any way, shape or form to distribute eRoutes or make eRoutes available to third parties, to connect eRoutes to a network enabling other devices to use eRoutes, to disassemble or decompile eRoutes or subject eRoutes to reverse engineering.
4.4. The User is not allowed to use eRoutes in an improper manner or in a manner that may adversely affect IMAGINE.
4.5. The User is also not allowed to remove, have removed, to circumvent or to have circumvented the technical provisions meant to protect eRoutes.
4.6. The User needs to treat the password on a strictly confidential basis. In case the password becomes known to a third party, the User has to change the password immediately or – in case he/she can not access his/her user account – has to contact IMAGINE via the website.


5. Termination of User rights
5.1. The User rights apply indefinitely, but the User can terminate the use of eRoutes at any given moment by canceling the monthly or yearly subscription.
5.2. IMAGINE has the right to terminate the user rights with immediate effect in writing without being liable to pay any compensation in case of – amongst others – abuse or unauthorized use of eRoutes. At the moment of termination of the user rights, the User will no longer use eRoutes and will remove his/her account.
5.3. IMAGINE has the right at all times to adapt eRoutes, to change data, to limit the use of eRoutes or to partially, temporarily or completely deny the User access to eRoutes.
5.4. IMAGINE can make an upgrade available for eRoutes. As defined in the Terms of Use the upgrade then qualifies as eRoutes.
5.5. The User has the obligation to take care that the use of eRoutes and the Subscription do not conflict the Terms of Use, any legal stipulations or third party rights. Besides that, in using eRoutes, the User will neither in any way cause a nuisance, cause damage or have damage caused at the expense of IMAGINE or third parties, nor use eRoutes in any way that interferes with the proper function of the services and/or eRoutes.
5.6. The use of eRoutes is for the own account and risk of the User.
5.7. IMAGINE is not liable for damage or injury resulting from the use of eRoutes and the services.
5.8. The User safeguards IMAGINE for all possible claims from third parties as a result of the use of eRoutes and/or the services. The User will pay for any reasonable damages and expenses (including but not limited to (extra)judicial costs) IMAGINE suffers as a result of such claims.
5.9. Within eRoutes, the User has the option to indicate whether his/her telephone number or e-mail address can be used by IMAGINE and by other companies within IMAGINE to approach the User with offers of similar products and/or services. At any given moment and only via eRoutes, the User can withdraw his/her permission. For more information concerning this, we refer to the Privacy Policy.
5.10. Except in the case of intent or gross negligence, IMAGINE is not liable for damages in any way, shape or form for temporary no, no correct or not complete availability of eRoutes and the not (fully) functioning of the (mobile) connection of the User, of IMAGINE or of third parties, as a result of which the services cannot be (completely) provided.

6. Responsibility for IMAGINE
6.1. All intellectual property rights and/or similar rights concerning the (content of the) Services, eRoutes, including the software behind it, images and video- and sound fragments are solely and exclusively vested with IMAGINE, or her licensors or the administrator of the eRoutes.
6.2. eRoutes has been built with the largest possible care. However IMAGINE cannot guarantee that eRoutes will always work without interruptions, errors or defects and that the information provided is always complete, correct and up to date. IMAGINE is committed to providing a well-functioning eRoutes and to solve any possible problem as quick as possible.
6.3. IMAGINE can put eRoutes temporarily or permanently out of order for the User(s), (without any notice) and without the User(s) being able to derive any rights.
6.4. IMAGINE is not responsible for any damages resulting from improper use of the Subscription. The User uses eRoutes and the Services at his/her own risk.
6.5. IMAGINE is not responsible for any damages resulting from the User having chosen an unsuitable password for the user account, or from unsafe saving of the password, or for any damages caused by a third party for who the User has enabled access to the services.

7. Amendments to these Terms of Use
7.1. IMAGINE has the right to from time to time make amendments and additions to these Terms of Use. The User will be able to always consult the most recent version via eRoutes. The User of eRoutes is advised to regularly check the content of these Terms of Use for amendments. In case of substantial amendments to these Terms of Use, a clear notification will follow, for example with a banner on this website or notification via eRoutes or via email.
7.2. By continuation of the use of eRoutes after the Terms of Use have been amended and/or the notification was sent out, the User accepts that the amended Terms of Use apply. All possible amendments in the Terms of Use come into effect within fourteen (14) days after the notification thereof via eRoutes, the website or via e-mail, unless another term was specifically mentioned.
7.3. In case the User does not accept the amendments to the Terms of Use, the User has to terminate the use of eRoutes. As far as amendments lead to substantial amendments with regards to the performances to be delivered by IMAGINE as stipulated in the User Agreement between IMAGINE and the User for the use of eRoutes, the User is given the opportunity to terminate this User Agreement by contacting eRoutes.

8. Final provisions
8.1. In case one or some of the aforementioned stipulations are or will be invalid, the validity of the other stipulations is not affected.
8.2. Dutch law exclusively applies to all disputes resulting from or in connection with eRoutes, the Services and/or the Subscription. With the exclusion of other (foreign) courts, the Dutch court has the jurisdiction to take note of a dispute.

eRoutes is part of Imagine Run BV. Therefore the privacy policy of Imagine Run BV applies to the use of eRoutes. 

This policy explains in which manner IMAGINE RUN BV (eRoutes) collects personal data both online and offline and how we use this data. eRoutes was developed under the responsibility of IMAGINE RUN BV.

Please read this privacy policy carefully. You then know if you wish to grant permission for the use of your personal data by IMAGINE RUN BV. IMAGINE RUN BV collects and processes personal data in accordance with the General Data Protection Regulations and not be able to process your personal data without your permission.

In general, we collect your personal data when you subscribe for our newsletter, when you create an account, when you send us an email and when you make use of our website, our apps and our social media.

In case you provide personal data via IMAGINE RUN BV, we will keep these data to be able to process your order or your order and to send you newsletters from time to time. These are the purposes of the data collection.

IMAGINE RUN BV is a responsible (This means an organization responsible for the processing of personal data in the sense of the General Data Protection Regulation) with regards to all the data IMAGINE RUN BV collects about you and receives when you make use of our services. IMAGINE RUN BV is bound to and uses your data in accordance with the General Data Protection Regulation, which becomes effective on the 25th of May 2018.

1. Cookies
Just like on a normal computer you can also be passed on to a website which uses cookies or is passed on via eRoutes. In case that occurs, please check the privacy policy of the website in question. On your telephone, you can indicate that you do not accept cookies. However, eRoutes does make use of cookies that collect personal data.

We collect your data in various manners:

a. Directly from you.
For instance when you subscribe for a newsletter or an action, when you create an account, participate in a match or a free contest, download an app, submit a reaction via (the contact form on) eRoutes, ask us a question, send us an e-mail or contact IMAGINE RUN BV in any way.

b. By the use of our website and apps.
You can browse and use our websites and our apps with a computer, a telephone, a tablet or another device. On our websites and our apps, we use tracking tools such as browser cookies and web beacons to collect data about your use.

c. From third parties.
For instance, when you choose to use an integrated social media function on our websites or our apps, this social media site will provide us with specific data about you, such as your name and your e-mail address. Your activities on our sites and apps can be placed on social media platforms.

2. The data about you we could save
For the purposes as described in this policy we use the following data:

a. Your contact- and account data.
We save the contact data provided by you (for instance name, address, telephone number, email, resident country, preferred language) when you create an eRoutes account, buy a ticket and/or participate in our contests or actions.

b. Your payment and invoice data.
In order to process your order, we save the payment and invoice data provided by you, such as for instance your credit card number and your postal code.

c. Data provided by you online.
We save for instance data which you placed on an external social media site to which we have access (such as reviews or questionnaires placed or filled-in by you) On placement of data online the rights of others may not be infringed ( this includes the right to privacy) and you need to be fully aware of the fact that others could use your data, could tag it and/or could re-publish it in unexpected (and even unlawful) ways.

You understand that we and other parties (including third parties who offer events via eRoutes) are allowed to use and re-publish your publicly placed online data. This includes the data you have placed via eRoutes or via social media functions. However, when using eRoutes we cannot accept responsibility for the further use of your personal data by third parties, in case you place an order or in case you otherwise share your personal data directly with such third parties.


3. Data about your preferences
We can collect data about your favorite events or about products you buy or make inquiries about (for instance as a part of a questionnaire or your review on an event). We can also save data about your interests and about your demographics, which we can deduct from your interactions with us, to provide you with better service or to provide you with more detailed information. For instance, when you buy a ticket for a specific event and lots of people who went to that event have also bought tickets for another event, we can send information about that event.

When you visit our website, we can collect data about the browser you use and about your IP-address. (This is the number with which specific network devices are identified on the Internet and which your device needs in order to communicate with websites) We can follow what you have and haven’t done on our website and which pages you visit when you have left our website.

4. We can use your data in the following ways and for the following purposes.
a. To provide you with products, services, account data, and support.
We can use your data to confirm your registration for an event. When you provide us with data about friends who ask for information, we will use this data to offer the services you ask of us. Please ask permission of these friends first before sharing their data with us. 

b. To send you messages regarding your transaction or regarding events you visited.
We can send you, for instance, an email about your account or your purchase or we can ask you to write a review about an event you visited. Besides that, we can send you a one-off email to remind you of an event which might be of interest to you based on tickets you have already bought or events you already visited.

c. To signal trends and interests.
We use your data in order to know about your preferences, so we can improve our offer to you and make your experience with us more specific and more personal.

d. The control and improvement of our products, services, and websites.
We analyze your data to improve our understanding of you and of our relations database in general. We do this in order to be able to make better decisions about our services, our marketing, our products, and our content. This is based on an improved image of how our clients use our current services and to more personalize their experience with us.

e. In case you have subscribed to a newsletter
In case you have subscribed to a newsletter via eRoutes, we are allowed to send you newsletters.

5. You have specific choices about how we use your data.
When you create an account or download and use our apps, we can also ask your permission to collect, process or use your personal data for specific purposes at a later moment. In case you want to opt out on the permission you gave us for the specific use of your personal data or in case you wish to see or alter your data, please write to us or state your preferences via the e-mail address app@imaginerun.com.

You can not only opt out in writing but also in the following ways:

a. You can opt out for the receipt of commercial messages.
In order to no longer receive emails, text messages or push messages from the app for promotional purposes, please follow the instructions in a commercial message you have received or e-mail to app@imaginerun.com. Even when you have opted out for the receipt of commercial messages, we will keep sending you transactional messages. This way we can still contact you about your orders.

b. You can opt out for the receipt of our newsletters
In order to no longer receive our newsletters, please change your account settings or follow the instructions which are in every newsletter. Or send an e-mail to app@imaginerun.com.

c. You can request us to provide an insight into the data about you we have stored. 
Via app@imaginerun.com you can also request us to alter or to completely erase your personal data.

6. We can share your data with the following third parties:

a. Within IMAGINE RUN BV
Within IMAGINE RUN BV we can share your data with all involved with our organization and for all purposes mentioned in this policy, but not for other purposes, unless you explicitly grant permission.

b. Third parties
We will only share your data with third parties other than mentioned under a., unless you have explicitly granted your permission. This way these parties can better analyze their visitors’ behavior and can provide better service and support to their visitors. In case they would like to use your data for other purposes than described in this privacy, you must be asked to explicitly grant your permission. Please check the privacy policy of the third party concerned in case you place an order there.

c. Third parties who supply the goods and services you have bought.
Your data can also be shared with third parties supplying the goods and services you have bought via our website (for example tickets or merchandise), so these can process and ship your order (by contacting you amongst others).

d. When we think this is necessary to comply with legislation or to protect ourselves or third parties.

About eRoutes

eRoutes is the total provider of recreational routes, offering an online route planner and mobile app. Our routes are accessible to everyone, available at all levels and can start from any location. Both applications offer routes and route guidance along the way. Our mobile app is free to download for iOS and Android and is available in English and Dutch. In addition to routes, the mobile app also provides training plans for walking and running. Our online route planner is available as a web application to plan your routes in advance and print or download your routes as a (gpx) file for a sports watch or GPS device. The route planner is currently available in Dutch and English. But soon Spanish, French, German and Italian languages will follow.

eRoutes is a start-up, founded in June 2017, under the name of Imagine Run. Based on John Lennon’s song Imagine, Imagine Run wants to create a healthier world. Our company was founded by entrepreneur Edwin Kuipers who had a strong personal motivation. Although he has been active all his life, at the age of 43 he suffered a sudden cardiac arrest. He survived the attack because of his good walking condition. During his recovery, Edwin didn’t feel like walking the same route over and over again. He came up with the idea of creating a mobile app that generates unique round routes. And so, the idea of the Imagine Run app was born. Imagine Run started with a big focus on improving people’s health. We quickly discovered that the best way to do so is to show them how easy and fun it is to move. So we started specializing ourselves in offering surprising routes all over the world. Along the way, we found out that the name Imagine Run no longer represents who we are and what we offer. We want to surprise you with new routes and help you discover the world around you, and that’s also where our strength lies. That’s why, from November 2019, Imagine Run is called eRoutes. The team behind eRoutes consists of nine energetic colleagues who are driven to let the whole world experience our surprising routes.
